The ninth circuit court has upheld a prohibition on deploying state troops in Portland, Oregon, after a latest court ruling.

Judicial Panel Concurs to Rehear Case

The ninth circuit court of appeals decided on this week that it would reexamine the case concerning the executive power with an expanded panel of 11 judges. The judicial body also overturned a earlier decision from a three-judge panel that had sided with the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent development in a long-running legal battle over whether the former president has the legal right and valid reason to deploy state military units in the city. Approximately 200 federalized guard members have been in uncertainty since late September when the deployment effort was initiated in due to months of protests.

Conflicting Arguments

The federal government has claimed that federal officials at the immigration center in south Portland were facing threats, while local authorities maintain that local officers have control of the circumstances.

In defiance of descriptions of the city as a conflict zone, locals have been posting footage of lush hiking trails and a thriving food scene, and planning events such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city enacted two temporary restraining orders this month – one blocking the federalization of the Oregon national guard, and another stopping the deployment of any military personnel in the state, after attempts to circumvent the first order by mobilizing troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the second ruling remained in place, blocking the physical sending of the troops.

Full Panel Consideration

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a panel of eleven justices.

“This decision demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The constitution limits the executive authority, and Oregon’s communities cannot be treated as a training ground for expansive government power,” said the legal representative in a statement.

“The judicial body is sending a definite signal: the president cannot send the military into American urban areas without cause. We will continue defending Oregon’s laws, values, and sovereignty as this legal proceeding moves forward and our fight continues in the courts.”
